These Terms and Conditions apply to your use of the Forever by Temptation website and to purchases made through the website.
Forever by Temptation is a registered business name of Protea Diamonds Pty Ltd, ABN 53 003 101 380, located at Level 7, 155 Castlereagh Street, Sydney NSW 2000.
By accessing this website, creating an account or placing an order, you agree to these Terms and Conditions. If you do not agree, please do not use the website.
Nothing in these Terms and Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
You may use this website for personal, lawful and non-commercial purposes, including browsing products and purchasing jewellery.
You must not:
use the website for an unlawful, fraudulent or malicious purpose;
interfere with the operation or security of the website;
attempt to gain unauthorised access to the website, customer accounts or associated systems;
introduce viruses, malicious code or other harmful material;
copy, scrape or commercially exploit website content without written permission; or
place false, speculative or fraudulent orders.
We may restrict or suspend access where we reasonably believe the website is being misused.
We take reasonable care to ensure product descriptions, photographs, dimensions, prices and other information are accurate.
Because jewellery is photographed under controlled lighting and displayed on different screens, colours and apparent sizes may vary slightly from their appearance in person.
Natural diamonds, gemstones and pearls may have individual characteristics and variations. These are part of their natural appearance and are not necessarily defects. Lab-grown diamonds may also display individual characteristics arising from their growth process.
Where a diamond or gemstone is supplied with an independent grading certificate, the specifications recorded on that certificate apply to that particular stone. Certification is included only where stated in the product description or order documentation.
Product photographs may be enlarged to show detail. Packaging and minor design elements may change without notice, provided the product remains consistent with its description and applicable consumer guarantees.
Unless otherwise stated, all prices are:
shown in Australian dollars;
inclusive of GST where applicable; and
subject to change before an order is accepted.
The price charged will be the price displayed at checkout when the order is submitted, subject to the correction of an obvious pricing or technical error.
If we discover an error affecting your order, we will contact you before processing it. You may confirm the order at the correct price or cancel it for a full refund. We will not charge a higher amount without your agreement.
Placing an order is an offer to purchase the selected product under these Terms and Conditions.
An automated order confirmation acknowledges that we have received the order. It does not necessarily mean the order has been accepted. An order is accepted when we confirm acceptance, commence an approved custom order or dispatch the product.
You must provide complete and accurate contact, billing and delivery information. Please review product details, metal type, diamond type, colour, ring size, engraving and other selected options before submitting the order.
We may contact you if additional verification is reasonably required to prevent fraud or confirm order details.
Products and materials are subject to availability. Placing an item in your cart does not reserve it.
We may cancel an order before dispatch if:
the product or required material is unavailable;
payment cannot be authorised;
the order appears fraudulent;
the delivery address cannot be serviced;
a material pricing or product-description error has occurred; or
accepting the order would breach the law.
If we cancel an order after receiving payment, we will provide a full refund using the original payment method, unless another method is agreed with you.
Custom-made, resized, engraved, etched, embossed or otherwise personalised products are manufactured according to the specifications approved by the customer.
You are responsible for checking all approved specifications, including names, dates, wording, spelling, measurements, ring size, metal, setting and stone selection.
Estimated production and completion dates are provided in good faith but may change due to material availability, design changes or circumstances outside our reasonable control. We will notify you of a material delay.
Once production or personalisation has commenced, the order cannot generally be cancelled or returned because of a change of mind. This does not affect your rights if the product is faulty, unsafe, materially different from the approved design or otherwise fails to meet a consumer guarantee.
Any deposit or cancellation arrangement applying to a custom order will be disclosed and agreed before work begins.
Customers are responsible for selecting the correct ring size.
Ring-sizing guides provide general assistance but cannot guarantee a perfect fit. We recommend having your finger professionally measured before placing an order.
Whether a ring can be resized depends on its design, setting, metal and the amount of adjustment required. Resizing may incur an additional charge unless required to remedy a fault or failure to comply with the Australian Consumer Law.
Available payment methods are displayed at checkout and may include credit or debit card, PayPal, Afterpay, Apple Pay or other approved services.
Payments are processed by third-party payment providers and may be subject to their terms and privacy policies. We do not store complete card details on our website.
You authorise us and our payment providers to process the payment associated with your order. Orders will not be dispatched until cleared payment has been received, unless otherwise agreed.
If you use a buy-now-pay-later service, your agreement with that provider is separate from your purchase agreement with us. Your consumer rights against Forever by Temptation are not reduced because you used a third-party payment service.
Promotions and discount codes:
must be used within the stated promotional period;
are subject to any advertised exclusions or minimum purchase requirements;
cannot be redeemed for cash;
cannot generally be combined unless expressly permitted; and
must be entered before the order is submitted.
We may withdraw or correct a promotion where there has been an obvious error, fraud or misuse, subject to applicable law.
Purchased gift cards will be valid for at least three years from their date of issue unless a longer period is stated. Any expiry date and restrictions will be clearly displayed.
We do not charge activation, account-keeping, balance-enquiry or inactivity fees after a gift card has been supplied.
Gift cards:
may be used for eligible Forever by Temptation purchases;
cannot ordinarily be exchanged for cash;
cannot be used to purchase another gift card unless permitted;
should be treated like cash; and
may not be replaced if lost or stolen unless we can verify ownership and the unused balance.
Promotional vouchers supplied free of charge or as part of a promotion may have different conditions and expiry periods, which will be disclosed with the offer.
Nothing in this section limits rights available under Australian law.
We currently deliver to eligible Australian addresses. We do not deliver to PO boxes because a signature may be required.
We aim to dispatch stocked products within two business days. Customised, personalised and made-to-order jewellery requires additional production time.
Delivery dates are estimates rather than guaranteed dates. Delays may occur because of production requirements, carrier disruptions, public holidays, regional delivery conditions or circumstances outside our reasonable control.
Tracking details will normally be emailed after dispatch. You are responsible for ensuring the delivery address is complete and correct.
Please contact us promptly if tracking shows that an order has been delivered but you have not received it, or if it appears lost or damaged in transit. We will work with the delivery provider and provide any remedy required by law.
Ownership passes to you once full payment has been received. Responsibility for the product passes to you when it is delivered to you or a person authorised to accept it at the nominated address.

In addition to your rights under Australian Consumer Law, we accept eligible products for a change-of-mind return or exchange within 30 days of delivery.
Before returning a product, you must contact our support team for return instructions.
To qualify for a change-of-mind return, the product must be:
new and unworn;
undamaged;
returned with its original packaging, certificates and paperwork; and
returned in a condition suitable for resale.
Custom-made, engraved, etched, embossed, resized or otherwise personalised products cannot be returned or exchanged for a change of mind.
The customer is responsible for safely packaging and returning a change-of-mind item unless we agree otherwise. We recommend using a tracked and insured delivery service because you remain responsible for the item until we receive it.
Approved refunds will ordinarily be returned to the original payment method. Delivery and return costs associated solely with a change-of-mind return are not refundable unless we agree otherwise.
These conditions apply only to change-of-mind returns. They do not limit your rights concerning faulty or incorrectly supplied products.
Our products come with guarantees that cannot be excluded under the Australian Consumer Law.
Products must be of acceptable quality, match their description, be fit for any disclosed purpose and meet any other applicable consumer guarantee.
If a product has a major problem, you may be entitled to choose a replacement or refund. If the problem is minor, we may choose to provide a repair within a reasonable time. Other remedies may also be available under Australian Consumer Law.
Consumer guarantees may continue to apply after the end of any manufacturer’s or voluntary warranty period.
Please contact us as soon as reasonably possible if you believe a product is faulty, damaged, unsafe, incorrectly supplied or materially different from its description.
We may ask for photographs, order details and other reasonable information, and we may need to inspect the product before confirming the appropriate remedy.
Where a product fails to meet a consumer guarantee, we will cover reasonable return costs where required by law.
Consumer guarantees do not generally cover damage caused by misuse, accidental damage, unauthorised alterations, failure to follow reasonable care instructions or ordinary wear and tear. This will depend on the circumstances and does not remove any rights you have under the law.
Fine jewellery requires reasonable care. Depending on the item, this may include:
avoiding impact, chemicals, chlorine and abrasive substances;
removing jewellery during physical work, sport or activities likely to cause damage;
storing jewellery separately and securely;
regularly checking clasps, settings and stones; and
arranging professional cleaning and inspection when appropriate.
Precious metals can scratch, bend or wear over time. Rhodium-plated white gold may require periodic replating. These changes may result from ordinary use and are not necessarily manufacturing faults.
Once a refund is approved, we will process it within a reasonable period using the original payment method unless another method is agreed.
Financial institutions and payment providers may require additional time to display the refund in your account.
If you paid using Afterpay, PayPal or another third-party provider, the refund will also be handled according to that provider’s procedures.
You are responsible for maintaining the confidentiality of your account credentials and for activities performed through your account.
Please notify us promptly if you believe your account has been accessed without permission. We may suspend an account where reasonably necessary to protect you, other customers or the website.
We handle personal information in accordance with our Privacy Policy and applicable Australian privacy laws.
Transactional communications relating to your order may be sent without separate marketing consent. Marketing communications will include an option to unsubscribe where required by law.
The website and its content, including text, photographs, product designs, graphics, logos, videos and software, are owned by or licensed to Protea Diamonds Pty Ltd and are protected by intellectual property laws.
You may view and print website content for personal, non-commercial use. You must not reproduce, modify, distribute, publish or commercially use website content without prior written permission.
The website may contain links to third-party websites or use third-party services, including payment, delivery, analytics and social-media services.
We are not responsible for the content, availability or privacy practices of an independent third-party website. Your use of third-party services may be governed by separate terms.
We aim to keep the website secure and available but cannot guarantee uninterrupted or error-free access.
We may temporarily suspend access for maintenance, security, technical or operational reasons. Where practical, we will take reasonable steps to minimise disruption.
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
To the extent permitted by law, we are not liable for loss arising solely from:
your misuse of the website or a product;
inaccurate information supplied by you;
unauthorised access caused by your failure to protect account credentials;
interruptions outside our reasonable control; or
indirect or consequential loss that was not reasonably foreseeable.
This section does not limit liability where doing so would be unlawful.
We may update these Terms and Conditions from time to time. The updated version will be published on this page with a revised date.
Changes will apply to website use and orders placed after publication. The terms applying to an accepted order will not be changed retrospectively without your agreement, except where required by law.
These Terms and Conditions are governed by the laws of New South Wales, Australia.
You and Forever by Temptation submit to the courts and tribunals having jurisdiction in New South Wales. This does not prevent you from exercising any rights you may have under applicable consumer legislation in another Australian state or territory.
